INFORMATION IN ACCORDANCE WITH THE EUROPEAN REGULATION 2016/679 (GDPR) with regard to the video surveillance system
Please note that Movex S.p.A. Italia (hereinafter the “Company”) turned on a video surveillance system that could process your personal data, i.e. your images. Therefore, we provide you with the following information.
Purposes
The video surveillance system aims to safeguard the access to the Company headquarters and offices and to protect the Company assets.
We think that the video surveillance system can help efficiently in detecting possible outbrakes of fire and other anomalous situations that could endanger the safety of assets and people. Moreover, it works as a deterrent against acts of vandalism, thefts or armed robberies, it can help in identifying possible offenders against the company asset and it can ease, in case of crimes, the exercise of the Company right of defence, under civil and criminal law, based on useful images.
In this respect, the installation of the video surveillance system appears to be justified by the type of property and it is based on the legitimate interest of the Company in protecting its own assets and the safety of people.
The processing of data through cameras pursues legitimate purposes and it is performed in compliance with the provisions of the Workers’ Statute (L. 20 May 1970, n. 300), the current law about the protection of personal data and the general regulation about video surveillance issued by the Privacy Authority for the protection of personal data on April 8th 2010.
Necessity and proportionality of the processing
In relations with the aforesaid purposes and given the characteristics of the system, the installation of the video surveillance system is to be considered necessary and commensurate.
The video surveillance system permits to upgrade people and assets safety and to ease the possible right of defence of the Company within the competent judicial authorities and, because of its features, it is not exorbitant compared to the aforesaid purposes.
The recording of the images is performed continuously within 72 hours. Auto zooms are not activated.
All recorded images can be accessed by specifically authorised people only and for reasons of unavoidable necessity exclusively, i.e.:

The recorded images can be viewed by people acting under the Company authority only and that have been specifically trained in writing. Moreover, these images can be viewed by the Company GEL Elettrica S.r.l. that provides the Data Controller with the video surveillance system. This company was appointed as Data Processor for this purpose. The updated list of the abovementioned subjects is available by requesting it to the Company.
Images retention period
Images are kept for 72 hours from their recording, without prejudice to any specific requests of the Judicial Authority; images are kept as long as it is necessary to watch them and evaluate how to proceed, compliant to the relevant authorities included. The deletion of the images is scheduled and automatic (re-recording). The implemented deletion modalities make the erased data no more exploitable.
Scope of communication of the recorded personal data
The personal data included in the images can be communicated to the competent legal authority or judicial police authorities in case of unlawful or suspected unlawful conducts.
Rights with regard to the protection of persona data and right to lodge a complaint to the Control Authority
The company will assure the exercise of your personal data, subject to the existence of the legal requirement and limited to the recording of the images.
Particularly, the data subject can contact the company by sending an email to info@movexii.com and ask the Data Controller in order to access his images, ask for the restriction of the processing and/or the deletion of the data, if applicable.
You also have the right to object, for reasons connected to your specific situation, if the processing is based on the legitimate interest. In this case the company won’t process your personal data further, unless it proves the existence of binding legitimate reasons to proceed with the processing prevailing on the interests, rights and freedom of the data subject or if the processing is necessary to verify, exercise or defend a right in judicial proceedings.
Portability right (art. 20 GDPR) is not exercisable since the processing is performed in execution of a legitimate interest of the Data Controller.
